GENERAL MEMBERSHIP MEETING

The CCASAPE General Membership Meeting will be held on Tuesday, June 5, 2007 , from 3:30 to 6:30 p.m. at the Palace Station Hotel. The CCASAPE business meeting will begin at approximately 4:45 p.m.

During the CCASAPE meeting, members will:

1. Be provided a review of the highlights of 2006-2007, including an update on the current Nevada Legislative Session and 2007-2009 Negotiations between CCASAPE and the District;

2. Receive the proposed slate of candidates for the June election and be provided an opportunity to nominate additional candidates;

3. Receive a copy of the 2007-2008 CCASAPE budget; and

4. Have the opportunity to socialize with their current colleagues, as well as, those who have retired.

The Clark County Association of Secondary School Principals and the Clark County Association of Elementary School Principals will hold end of the year business meetings at the same location beginning at 4:00 p.m.


CCASAPE NOMINATIONS AND ELECTIONS COMMITTEE IS SEEKING CANDIDATES FOR CCASAPE OFFICE

John Barlow, Chairperson of the CCASAPE Nominations and Elections Committee, along with committee members Beth Howe and Andrea Klafter-Phillips are seeking candidates to run for the CCASAPE Executive Board and the Representative Council. Members interested in serving on the Executive Board and/or Representative Council may contact one of the individuals on the Nominations and Elections Committee or the CCASAPE office at 796-9602.

This committee will propose a slate of candidates for nomination at the General Membership Meeting to be held at the Palace Station Hotel on Tuesday, June 5, 2007 . Whenever possible, there will be a minimum of two (2) candidates for each office to be filled. Additional nominations, with the consent of the person being nominated, may be made at the June 5, 2007 , General Membership Meeting.

Executive Board offices to be filled during the election include President Elect (must be an active CCASAPE member who is a secondary school administrator), Secretary and Treasurer. The offices of Secretary and Treasurer are open to anyone who is an active CCASAPE member. Candidates receiving a majority of votes cast by mail ballot shall be elected to the offices. These offices are for a one (1) year term.

Four (4) Representative Council positions are elected each year. The four (4) at-large positions are filled by the four (4) at-large candidates receiving the greatest number of votes. These positions are for two (2) year terms.

CCASAPE encourages members to run for office. The Executive Board and the Representative Council are the decision-making bodies of CCASAPE.


HEALTH BENEFIT PLAN UPDATE

As previously reported in multiple Unifiers, out-of-pocket costs for administrators and retirees with dependents on POS Plans One and Two, and HMO Plan Three will increase on July 1, 2007 . Because the cost increase constitutes a 125 Plan qualifying event, administrators and retirees will have an opportunity to switch from their current plan to one with lower premiums. Administrators will not be able to add additional dependents at this time unless the addition of the dependent is precipitated by a qualifying event.

Administrators and retirees desiring to change plans due to the July 1, 2007 , cost increase must notify Karen White in the District’s Benefit Office prior to June 29, 2007 . If you have questions regarding plan options and pricing, please contact the CCASAPE office at 796-9602.

Open enrollment for the health benefit plan sponsored by the School Administrators’ and Professional-technical Employees’ Welfare Trust will, as always, be held in October and November with an effective date for any changes that are made of January 1, 2008.


CCASAPE SCHOLARSHIP RECIPIENTS

Each year CCASAPE provides two (2) scholarships in the amount of $1,000.00 each. Each applicant must be a senior enrolled in the Clark County School District and a legal dependent of an active CCASAPE member.

Applications were received from 7 outstanding students. The Scholarship Committee, composed of high school administrators, Susan Segal, Rich Arguello, and Roxanne Kelley selected Benjamin Grainger of Valley High School and Courtney Waldron of Advanced Technologies Academy . These two outstanding recipients were selected on the basis of their grade point averages, test scores, recommendations, essays, and from their personal resumes. Benjamin is the son of CCASAPE member John Grainger. Courtney is the daughter of CCASAPE member Bradley Waldron.

Bart Mangino, CCASAPE President, will present the scholarship checks to the recipients at the May 31, 2007 , meeting of the Board of School Trustees.

Congratulations are extended to all of the outstanding applicants, recipients, and their families.
MAY REPRESENTATIVE COUNCIL MEETING

On May 10, 2007 , the CCASAPE Representative Council held its regular monthly meeting. The major items discussed and/or actions taken during the Representative Council meeting included the following:

1. The revenue, expenditures, and balances within the CCASAPE Association and Trust Fund Accounts;

2. Old Business:


A. School Administrators’ and Professional-technical Employees’ Welfare Trust – A status report on the various tasks remaining to be completed for the Trust to become a free standing entity from the Association was provided. A draft copy of the newly developed Participation Agreement was reviewed. The Participation Agreement will enable employees of the Association to participate in the benefits provided through the Trust;

B. 74 th Nevada Legislative Session – Stephen provided an overview of selected bills and outlined CCASAPE efforts put forward to defeat AB459;

C.
2007-2009 Negotiations – The Representative Council reviewed suggested changes in the proposed Articles for negotiations. Changes were authorized for Articles 18 and 20. Stephen outlined the work completed at the three CCASAPE Negotiations Team work sessions and reminded the Council that the first formal session with the District Team was scheduled for May 16, 2007;

D.
CCASAPE Scholarships – The CCASAPE Scholarship Committee consisting of Susan Segal, Rich Arguello, and Roxanne Kelley selected Benjamin Grainger and Courtney Waldron as this year’s scholarship recipients; and

E.
May 2, 2007 , Administrators’ Advisory Council Meeting – Agenda items for the May 2 nd meeting were reviewed. Topics included legislative issues, school climate concerns, Teachers4change, school safety issues / school police protocols, staffing, year round school conversion process, and administrative staffing in rural schools;

3. New Business:

A. CCASAPE Elections – The status of the forthcoming CCASAPE elections was discussed. Ballots will be mailed to the membership on June 8 and must be returned to the CCASAPE office with a postmark of not later than June 29, 2007 ;

B. General Membership Meeting – Stephen reviewed the final arrangements that have been made for the June 5 General Membership Meeting at the Palace Station;

C. Proposed 2007-2008 CCASAPE Budget – The Representative Council approved the 2007-2008 CCASAPE budget. The budget will be distributed to attendees at the General Membership Meeting and will be published in the June/July Unifier;

 D. Proposed Unused Sick Leave / Retiree Medical Payouts – The Representative Council authorized the June payouts for unused sick leave and retiree medical benefits; and

E. CCASAPE Sick Leave Pool – Donation letters will be included in the May Unifier (see inserts) for administrators to donate days to the sick leave pool;

4. Committee Reports:

A. CCAESP – Karen Smallwood, President, reported that networking luncheons were recently held and that elections will occur during May;

B. CCASSP – Jeff Geihs, President, reported that the Administrators’ Advisory Council agenda and school climate and safety concerns had been discussed with the CCASSP Board;

C. Legal Committee – Charles Anderson, CCASAPE President-elect, indicated there was no legal activity to report; and

5. Executive Director’s Report – Stephen provided a review of the accountant’s report, membership report and the various CCASAPE activities and the types of assistance provided to CCASAPE members.


CCASAPE SICK LEAVE POOL

The current Agreement between the Clark County School District and the Clark County Association of School Administrators and Professional-technical Employees establishes a pool of sick leave days available to administrators who have no other available leave and outlines two methods by which administrators may donate days to the sick leave pool.

Method One :

The pool of days is created by administrators who voluntarily designate a half day or a full day of vacation for which they would otherwise be compensated under Article 18-4. Administrators must have in excess of 85 vacation days on June 30 to be eligible to donate days to the sick leave pool.

 Method Two :

During the 2005-2006 contract negotiations, an additional mechanism was developed that allows administrators to donate sick leave days to the CCASAPE sick leave pool. Administrators are eligible to donate a day of sick leave when they have accumulated 60 or more days and have utilized three (3) or fewer days of sick leave during the current contract year, 2006-2007.

Form letters are provided in this edition of the Unifier for your use if you would like to designate a half day or a full day of vacation (Method One) or a full day of sick leave (Method Two).

 The criteria identified in Method One or Method Two must be met in order for you to donate to the sick leave pool.

YOUR GENEROSITY TODAY WILL BE A CRITICAL PIECE IN THE WELFARE OF A CCASAPE MEMBER IN THE FUTURE.


2007-2009 NEGOTIATIONS BETWEEN CCASAPE AND THE DISTRICT

Formal negotiations between CCASAPE and the District began May 16, 2007 . Formal meetings are currently scheduled through the end of June. In preparation for negotiations with the District, CCASAPE completed a comprehensive analysis of the current contract to identify required language changes and tentative topics for negotiations. This analysis, along with the member input that was received and recommendations from the CCASAPE Compensation Committee, was presented to the Representative Council in March. Three work sessions were held with the CCASAPE Negotiations Committee prior to the May 16th meeting with the District team. Negotiations cannot be concluded until after the Legislature makes final decisions regarding money issues.

ASSEMBLY BILL 459 WITHDRAWN BY AUTHOR

CCASAPE extends its appreciation and thanks to the many administrators who personally made telephone calls and/or provided written correspondence to legislators regarding AB459. Rich Arguello, SNVTC principal, along with Mark Coleman and Stephen Augspurger testified at the May 9th hearing which was video conferenced to the Grant Sawyer Building in Las Vegas . Craig Kadlub and Bill Hoffman provided excellent testimony in Carson City . Also a critical piece to this process was the many building principals who marshaled the efforts of teachers and parents in opposition to this bill. CCASAPE acknowledges the efforts of Allin Chandler and his ongoing work with all aspects of the CCASAPE legislative effort. Also appreciated are the efforts of the CCASAPE lobbyist in Carson City , Lonnie Shields, and CCSD lobbyists, Joyce Haldeman, Craig Kadlub, and Rose McKinney James, for their ongoing efforts in working with legislators to defeat AB459.


LEGISLATIVE UPDATE

To date, 1464 bills have been introduced. CCASAPE has analyzed 229 bills. Of these bills, 187 address issues of concern to CCASAPE members. Seventy-six (76)pages of bill analysis have been written to date.

The following bills are being tracked by CCASAPE and are summarized for your information:

AB70 Revises existing law regarding compensation of school board members to increase the monthly salary to $2,000 in counties with a population greater than 100,000. CCASAPE supports this bill.

AB107 Existing law stipulates that a person who possesses a prohibited weapon is guilty of a gross misdemeanor punishable by not fewer than 15 days in jail and with a fine of not more than $2,000. This bill adds a knife with a blade of two inches or more to the list of prohibited weapons. This bill has been amended, but still contains provisions which CCASAPE opposes. CCASAPE believes this bill must be amended to allow for flexibility for dealing with students who unintentionally bring a prohibited knife to school and cannot support the bill in its present form.

AB157 Provides for full day kindergarten.

AB212 This bill requires high schools to develop a 4-year plan for each pupil in consultation with the parent; requires each high school to develop a school within a school for 9 th grade students and designate certain school personnel to work only with 9 th grade students; requires that a uniform grading policy be developed for all public high schools; and requires that a policy be adopted that will limit the responsibilities for school counselors with regard to the school-wide testing program. CCASAPE opposes this bill.

AB280 This bill provides a $2,000 salary increase for each licensed teacher in Nevada . CCASAPE supports this bill as long as it applies to other education personnel.

AB324 This bill requires that a school district pay a subsidy for retiree health care for those retirees who do not enroll in the state health insurance program and remain in a District sponsored plan. The subsidy would be paid at the same rate as the retirees who elect to go into the state health insurance program. CCASAPE supports this bill.

AB459 This bill creates a teacher bill of rights. This bill will significantly change the way principals fulfill their supervisory responsibilities with teachers. CCASAPE opposes this bill. THIS BILL WAS WITHDRAWN BY ITS AUTHOR.

AB460 This bill specifies a required number of minutes for administrators conducting classroom observations and requires that a statement be placed in the evaluation regarding the number of minutes that the administrator personally observed the teacher and must include a list of deficiencies and what the administrator will do to assist the teacher. This requirement to document time will provide an additional reason forteachers to dispute evaluations. CCASAPE will seek to remove the requirement to include the amount of time the administrator must be in the classroom for evaluation purposes. CCASAPE is opposed to this bill in its present form.

AB563 This is the iNVest bill. CCASAPE supports this bill with the exception of Section 3 which protects school district ending fund balances up to 8.3%. CCASAPE will seek to amend this section.

SB2 This bill appropriates sufficient funds to ensure that the money expended per pupil in this State meets or exceeds the most current national average. CCASAPE supports this bill.

SB57 Existing law requires the parole or probation officer who supervises a child who has been adjudicated for a sexual offense or sexually motivated act to provide notice to the superintendent of the school district in which the child resides. If the victim of the sexual offense or sexually motivated act attends a public or private school in this State, the notification must include the name of the victim. This bill requires the parole or probation officer to obtain the written consent of the parent or guardian of the victim before including the name of the victim in the notification. CCASAPE worked to amend this bill to ensure the principal is notified when both the victim and the offender attend the same school. However, this bill passed both houses and was signed by the governor.

SB110 This bill reduces the number of required examinations administered to students. CCASAPE supported this bill in its original format. This bill has been amended and now stipulates that required tests and assessments must be limited to those which can be demonstrated to provide a direct benefit to pupils or which are used by teachers to improve instruction. This bill also requires an assessment of the number of hours pupils spend testing. CCASAPE supports this bill.

SB123 This bill makes significant changes to how members of the public may access the public records of a public or governmental agency. CCASAPE has not developed a position on this bill. However, this bill has been amended to delete the provisions which would allow confidential information to be released to the public. CCASAPE will continue to monitor this bill.

SB143 This bill has been amended to make optional the requirement that schools provide a parent report card on the involvement of the parent in the education of the pupil. Even in its amended form, this bill still requires a parent signature on the currently required code of honor. Previously, no signature was required. This bill will require additional work and expense for school administrators. CCASAPE remains opposed to this bill.

SB166 This bill increases the salaries of certain employees who hold national certification. CCASAPE will seek to amend this bill to include those professional-technical employees who must hold national certification.

SB223 This bill directs the Legislative Commission to appoint an interim committee to conduct a study to develop a plan for the deconsolidation of the CCSD. CCASAPE opposes this bill.

SB238 This is Governor Gibbon’s empowerment bill. The language and funding for this bill have not been finalized.

SB305 This bill authorizes the Board of County Commissioners or the governing body of a city to veto matters passed by the Board of School Trustees. CCASAPE opposed this bill in its original form. The language of this bill has been deleted in its entirety and replaced with a bill which provides money appropriations for various programs.

SB328 Initially this bill contained language that will require administrators to be engaged in an annual classroom instruction and observation for at least one regularly scheduled full instructional day that is appropriate for the responsibilities, position, and duties of the

administrator. This bill is the same bill that Senator Beers introduced during the 2005 Legislative Session. This bill has been significantly amended. This amendment specifies that the instructional / observation requirements of this bill do not apply to school level administrators. Additionally, it specifies that district level administrators who hold a license to teach must provide instruction in a core academic subject in a classroom for at least one regularly scheduled full instructional day in each school year. Those district administrators that do not hold a license to teach must personally observe a classroom for one half of a regularly scheduled full instructional day in each school year or participate in activities with pupils in the classroom in each school year including, without limitation, serving as a guest speaker in the classroom, reading to pupils in elementary schools, and participating in career day. Additionally, this amendment specifies what must be included in the evaluation of a probationary and post probationary teacher. CCASAPE opposes this bill.

SB354 This bill defines the scope of authority of school police officers, including authority to issue traffic citations on any public street near any public school. CCASAPE is opposed to school police officers issuing traffic citations and will seek to amend this bill.

SB397 This is a CCSD bill that has changed significantly from the original CCSD bill draft. This bill requires administrative sanctions similar to those of the juvenile court system be imposed on habitual truants by a school police officer or a person designated by the principal. This bill requires that the parent of the habitual truant may not renew his vehicle registration until all administrative fines imposed against the parent are paid. This bill requires the principal or designee to impose the administrative sanctions and fines and notify the DMV regarding the driver’s license, as well as, collect the driver’s license if it is suspended. Parents may request a hearing before the principal. The principal’s written decision is subject to judicial review in district court. CCASAPE is concerned that the work of the school principal continues to increase and will likely seek to amend this bill.

SB534 A CCSD bill which extends the jurisdiction of school police officers to issue traffic citations during the time school is in session on adjacent streets. CCASAPE is opposed to this bill.

It is suggested that CCASAPE members take the time to become familiar with proposed legislation and contact legislators to convince them of the need to increase funding for K-12 education and to not pass legislation which would be harmful to administrators and education. RETIREE REMINDER LIFE INSURANCE AND AFFILIATE DUES
DUE BY JUNE 1, 2007

On May 1, 2007 , information was mailed to all retirees participating in the $100,000 group life insurance policy. Retirees are reminded that premiums for the life insurance policy are due to the School Administrators’ Welfare Trust not later than June 1, 2007. Additionally, those retirees wishing to remain as affiliate members, must also remit their annual dues of $30.00 by June 1, 2007.

ARTICLE 5 – MILEAGE

Administrators not assigned a district car or provided transportation in a district vehicle and who, at the time of their appointment/reassignment, live forty or more miles one way from their assigned work location shall receive an annual stipend of $1,500. The District shall pay eligible administrators in one check on or before June 25. Assignments of less than a full contract year shall be prorated.

Administrators should notify their region supervisor in writing if they believe they are eligible to receive the mileage stipend.
